These Terms and Conditions apply to all offers, orders and agreements concluded through the Cortazu website and any related distance sales channels.


Article 2 – Definitions

Consumer: A natural person acting for purposes outside their trade, business, craft or profession.

Cortazu: Cortazu B.V.

Distance Contract: Any contract concluded between Cortazu and a Consumer through an organised distance sales system without the simultaneous physical presence of both parties.

Product: Any item offered for sale by Cortazu.

Article 3 – Applicability

These Terms and Conditions apply to all offers, orders, purchases and agreements between Cortazu and Consumers.

Before placing an order, Consumers shall be able to review these Terms and Conditions. By placing an order, the Consumer accepts these Terms and Conditions.

Any conflicting conditions proposed by the Consumer are expressly excluded unless agreed otherwise in writing.


Article 4 – Offers and Product Information

Cortazu makes every effort to ensure that product descriptions, images and specifications are accurate.

Obvious errors, typographical mistakes, pricing errors or manifest mistakes do not bind Cortazu.

Product images are intended to provide a realistic representation. Minor variations in colour, materials or appearance may occur.

All offers are subject to availability.


Article 5 – Formation of the Contract

A contract is concluded once:

  1. The Consumer places an order;

  2. Payment is successfully authorised (where applicable); and

  3. Cortazu confirms acceptance of the order by email.

Cortazu reserves the right to refuse or cancel orders where:

  • Fraud is suspected;

  • Incorrect pricing has been published due to a technical error;

  • Products are unavailable;

  • The order cannot reasonably be fulfilled.

Where payment has already been made, any amounts paid will be refunded without undue delay.


Article 6 – Prices and Payment

All prices displayed on the Website include VAT where applicable.

Shipping costs, duties and other charges are clearly disclosed before checkout.

Accepted payment methods are displayed during checkout.

Ownership of products remains with Cortazu until full payment has been received.


Article 7 – Delivery

Orders are delivered to the address provided by the Consumer.

Delivery times displayed on the Website are estimates unless expressly stated otherwise.

If a Product cannot be delivered within 30 days after conclusion of the contract, the Consumer may terminate the agreement unless a different delivery period was expressly agreed.

Risk of loss or damage transfers to the Consumer when the Product is delivered to the Consumer or a third party designated by the Consumer.


Article 8 – Right of Withdrawal

Consumers have the right to withdraw from the contract within 14 days without giving any reason.

For goods, the withdrawal period expires 14 days after the day on which the Consumer, or a third party designated by the Consumer, receives the Product.

To exercise the right of withdrawal, the Consumer must notify Cortazu through a clear statement by email or through the return process made available on the Website.

The Consumer may also use the model withdrawal form provided below but is not required to do so.


Article 9 – Effects of Withdrawal

If the Consumer withdraws from the contract, Cortazu will reimburse all payments received from the Consumer, including standard delivery costs.

Reimbursement will be made without undue delay and no later than 14 days after receiving notice of withdrawal.

Cortazu may withhold reimbursement until:

  • The returned Product has been received; or

  • The Consumer provides evidence that the Product has been returned,

whichever occurs first.

Refunds will be made using the same payment method used for the original transaction unless otherwise agreed.

The Consumer is responsible only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Product.


Article 10 – Return Costs

Unless otherwise stated on the Website, the Consumer bears the direct costs of returning Products.

The Consumer must return Products without undue delay and no later than 14 days after communicating withdrawal.


Article 11 – Exceptions to the Right of Withdrawal

The right of withdrawal does not apply where permitted under applicable law, including but not limited to:

  • Products made to the Consumer's specifications or clearly personalised;

  • Sealed goods not suitable for return due to health protection or hygiene reasons where the seal has been broken after delivery;

  • Goods that deteriorate or expire rapidly;

  • Sealed audio, video or software products unsealed after delivery;

  • Digital content supplied electronically where performance has begun with the Consumer's prior express consent and acknowledgement that the right of withdrawal is lost.


Article 12 – Legal Warranty and Conformity

Consumers are entitled to the statutory warranty rights provided under Dutch and European consumer law.

Cortazu guarantees that Products conform to the contract, possess the characteristics reasonably expected and comply with applicable legal requirements.

Any commercial warranty offered by Cortazu or a manufacturer is in addition to, and does not limit, statutory rights.


Article 13 – Complaints

Complaints may be submitted via:

support@cortazu.com

Cortazu aims to respond within 14 days of receipt.

If a complaint requires longer handling, Cortazu will provide an acknowledgement and indication of the expected response time.

Consumers residing in the European Union may also use the European Online Dispute Resolution platform where available under applicable law.


Article 14 – Liability

Nothing in these Terms excludes or limits liability where such exclusion would be unlawful.

Cortazu shall not be liable for indirect or consequential damages except where liability cannot legally be excluded.

Where permitted by law, Cortazu's liability shall be limited to the purchase value of the Product giving rise to the claim.

This limitation does not apply in cases of intentional misconduct, gross negligence, death, personal injury, product liability or other liability that cannot be limited under applicable law.


Article 15 – Intellectual Property

All intellectual property rights relating to the Website, content, branding, logos, images, designs and materials belong to Cortazu or its licensors.

No rights are granted to Consumers other than those necessary for personal use of the Website and purchased Products.


Article 16 – Force Majeure

Cortazu shall not be liable for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, pandemics, strikes, transport disruptions, governmental measures or failures of suppliers and service providers.


Article 17 – Applicable Law

These Terms and Conditions are governed by Dutch law.

If the Consumer resides in another EU Member State, mandatory consumer protection provisions of that Member State remain applicable where required by law.

Any disputes shall be submitted to the competent courts of the Netherlands unless mandatory consumer protection rules provide otherwise.
